WARRANTY

WARRANTY TERMS

RMS-Acoustics products are designed and manufactured in the USA with great care and attention to
detail. The highest effort is put forth to ensure defect-free performance. RMS-Acoustics offers the
following warranty, which covers product purchased directly from an authorized RMS-Acoustics dealer
in the United States and Canada, or international distributor. This warranty covers product which
has been installed and operated under normally accepted standards and conditions.

RMS-Acoustics warrants its products to be free from defects in workmanship, materials, and
malfunctions for the following specified lengths of time:

5 Years Loudspeaker Systems	Loudspeaker Systems – To include all standard, custom, and weather-resistant enclosures, transducers, passive crossover assemblies, and enclosure hardware.
3 Years Components	To include all loudspeakers sold by RMS-Acoustics, including standard models and custom products.
3 Years Active Electronics	To include all RMS-Acoustics or Linea Research branded power amplifiers, digital signal processing, and active loudspeaker electronics assemblies.
2 Years Accessories	To include all standard rigging components not included with a finished loudspeaker product, hardware, both standard and custom, loudspeaker poles, and covers.

The warranty period shall commence on the date of delivery to the end user from an authorized RMS-Acoustics Dealer or authorized RMS-Acoustics Distributor. Within the period of this warranty and at the sole discretion of, RMS-Acoustics or an authorized RMS-Acoustics Service Representative will repair or replace at no charge at its service facility any RMS-Acoustics product or part thereof that is defective in material or workmanship. Any labor, materials, equipment rental charges, insurance, or any other incidental costs incurred to access products from a remote location are EXCLUDED from this warranty. Final determination of warranty coverage lies solely with an authorized RMS-Acoustics representative.

RMS-Acoustics neither assumes nor authorizes any representative or other person to assume on its behalf any other liability in connection with the sale or any shipment of RMS-Acoustics products.

The RMS-Acoustics liability under this product warranty shall be limited to the total purchase price for any warranted product, by the original dealer or distributed dealer of sale. RMS-Acoustics shall have no liability for any loss of use, interruption of business, loss of profits or goodwill, or for any special, incidental or consequential damages of any kind arising from the purchase of use of RMS-Acoustics products, even if RMS-Acoustics has been advised of the possibility of such loss, interruption of damage, and regardless of the form of action, whether in contract, tort, strict liability or otherwise.

WARRANTY EXCLUSIONS

RMS-Acoustics shall not be held liable for any incidental or consequential damages resulting from the use of its products. This warranty does not extend to products with modified or missing serial number(s), or to damage or malfunctions resulting from, but not limited to:

• Normal wear, misuse, neglect, abuse, improper installation, improper shipment, or accidents.
• Exterior defects in, or damage to the exterior appearance that were incurred at any time during or after delivery of the product.
• Repairs and or modifications performed by any entity other than RMS Acoustics, an authorized RMS-Acoustics Service Representative, or an authorized RMS Acoustics Distributor.

WARRANTY SERVICE

RMS-Acoustics will provide a Return Material Authorization (RMA) number for all returned products. Returns must be clearly marked with this number. RMS-Acoustics will not accept any products returned without an assigned RMA number. Enclose proof of the original delivery date, a description of the suspected defect or malfunction, and the conditions, if any, under which the issue occurred. Return the product to RMS-Acoustics, an authorized RMS-Acoustics Service Representative, or your local authorized RMS-Acoustics Distributor as instructed when the RMA number is generated.

WARRANTY SHIPMENT

You are responsible for prepaying shipping costs to RMS-Acoustics, an authorized RMS-Acoustics Service Representative, or your local authorized RMS-Acoustics Distributor. RMS-Acoustics will not be responsible for shipping damage resulting from inadequate packing. Any products received with damage due to improper packaging will be deemed out of warranty. RMS-Acoustics will only be responsible for prepay return shipping costs to the point of origin for standard, ground transportation if the product is found to be under warranty. Expedited shipping methods may be accommodated with the user paying the difference between ground shipment and the chosen method.

WARRANTY RIGHTS AND LEGAL OBLIGATIONS

THERE ARE NO OTHER WARRANTIES, EXPRESS OR IMPLIED, GIVEN BY RMS-ACOUSTICS EXTENDING BEYOND OR DIFFERENT FROM THE EXPRESS WARRANTY STATED HEREIN. RMS-ACOUSTICS MAKES NO WARRANTY OR REPRESENTATION THAT ITS PRODUCTS WILL OPERATE ERROR FREE OR WITHOUT PROBLEMS OR INTERRUPTION, EXPRESSLY DISCLAIMS ANY IMPLIED WARRANTIES INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

You have specific legal rights under this warranty. You may have additional rights that are specific for your region. Additionally, the applicability of certain provisions of this warranty may vary for your region. In no event shall this warranty affect your statutory rights.
